Network Gap Exception: Get Out-of-Network Care Covered at In-Network Rates
How to request a network gap (adequacy) exception, with a free sample paragraph.
If no in-network provider can reasonably deliver the care you need (because of specialty, distance or wait time), many plans will consider a gap exception so an out-of-network provider is paid at in-network rates. Ask before treatment when you can.
Free sample appeal paragraph
I request a network gap exception for [service] with [out-of-network provider]. I contacted the following in-network providers: [names, dates, outcome: not accepting patients / wait of X months / does not perform this procedure]. Because no in-network provider can provide this care in a timely manner within a reasonable distance, I ask that the plan cover it at the in-network benefit level.
Replace the [brackets] with your details. This is a starting point, not legal advice.
What to do
- Keep a call log with names, dates and what each provider said.
- Have your doctor explain why the specific expertise is needed.
- If the plan says no, ask your state insurance department about network adequacy rules.

Is a gap exception the same as an appeal?
Not exactly. It's often a pre-service request. If it's denied, you can appeal that denial.
Will the out-of-network provider still balance bill me?
It depends on the arrangement. Ask the plan whether it will negotiate a single-case agreement with the provider.
How do I appeal a network gap exception denial?
Start with the instructions and deadline on your denial letter. Gather your medical records and a letter of medical necessity, respond directly to the stated denial reason, and file an internal appeal. Keep proof of submission.
Is external review available?
For many non-grandfathered plans, independent external review may be available for denials involving medical judgment after a final internal denial, generally within 4 months. Confirm on your denial notice.
